Terms of Facilitation & Patient Agreement
Terms governing non-clinical medical travel facilitation, patient autonomy, hospital independence, and platform coordination boundaries by Nirogyam Healthplexes.
1. Facilitation Scope — Nirogyam Is NOT a Hospital
Nirogyam Healthplexes Pvt. Ltd. is a medical travel facilitation platform and journey concierge. Nirogyam is not a hospital, clinic, diagnostic lab, or licensed healthcare provider. We do not practice medicine, render clinical advice, perform surgeries, or establish doctor-patient relationships. Our services are strictly confined to non-clinical logistical coordination, hospital liaison, travel arrangements, and translation assistance.
2. Clinical Autonomy of Treating Hospitals
All clinical consultations, procedural recommendations, surgical plans, prescription medicines, and clinical outcomes are the sole and exclusive responsibility of the treating hospital and its credentialed medical staff. The patient acknowledges that any medical treatment agreement is executed directly between the patient and the chosen hospital.
3. Patient Autonomy and Hospital Choice
The patient retains complete autonomy over hospital and city selection. Nirogyam provides objective, text-verified information regarding institutional accreditations and clinical specialties. Nirogyam does not steer patients toward high-commission providers and does not levy broker markups on hospital invoices.
4. Limitation of Liability
To the maximum extent permitted by applicable law, Nirogyam Healthplexes shall not be liable for any clinical negligence, surgical complications, diagnostic errors, hospital billing disputes, or adverse medical outcomes arising from treatment rendered by third-party healthcare institutions.
5. Pricing, Quotations & Foreign Currency Facilitation Reference Rate
Foreign Currency Reference Rate: All foreign currency quotations provided by Nirogyam (including USD quotations) are calculated using a standardized quotation reference rate established by Nirogyam for international facilitation purposes.
Not a Bank Rate: The Nirogyam reference exchange rate is used solely for quotation purposes and is not represented as the prevailing market or bank exchange rate on the date of payment.
Settlement Currency: Final hospital billing and payment settlements in India are processed in Indian Rupees (INR) or through authorized international banking channels in accordance with the treating hospital's commercial policy and applicable Reserve Bank of India (RBI) / Foreign Exchange Management Act (FEMA) regulations.
Currency Fluctuations: Any variance between the Nirogyam quotation reference rate and the prevailing bank exchange rate at the time of payment or settlement by the patient's card, wire transfer, or foreign exchange provider is the sole responsibility of the paying party. Nirogyam does not provide currency hedging or foreign exchange conversion services.
